Terms & Conditions

These Terms govern the freight forwarding and logistics services provided by Bubaissyk ("we", "us", "our") to our customers ("you"). Please read them carefully before requesting or using our services.

1. Acceptance of Terms

By requesting a quotation, placing a booking, or otherwise using any service provided by Bubaissyk, you agree to be bound by these Terms & Conditions. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

Where applicable, our services are also subject to the standard trading conditions of the relevant freight forwarders' association and to international conventions governing the carriage of goods (such as the Hague-Visby Rules, the CMR Convention, the Montreal Convention or the relevant rail conventions), which may limit our liability.

2. Definitions

  • "Services" means freight forwarding, transport arrangement, customs brokerage, warehousing, tracking and any related logistics services we provide.
  • "Goods" means the cargo, items or consignments tendered to us for transport or handling.
  • "Customer" means the person or entity that requests or receives the Services.
  • "Carrier" means any third party that physically transports the Goods by sea, air, road or rail.

3. Scope of Services

Bubaissyk acts as a freight forwarder arranging the transportation, handling and clearance of Goods. Unless we expressly agree in writing to act as a carrier, we contract as an agent arranging services with third-party carriers and providers on your behalf. We will exercise reasonable care and skill in selecting and instructing such third parties.

We reserve the right to choose the means, route and procedure to be followed in handling, storing and transporting the Goods, except where you have given specific written instructions that we have accepted.

4. Quotations & Pricing

Quotations are based on the information you provide and on rates, surcharges, exchange rates and conditions in effect at the time of quoting. Quotations are valid only for the period stated and may be revised if any of these factors change, or if the actual weight, dimensions or nature of the Goods differ from those declared.

Unless stated otherwise, quotations do not include duties, taxes, inspection fees, demurrage, detention, storage or other charges imposed by authorities or third parties, which remain your responsibility.

5. Bookings & Your Obligations

You warrant that you are the owner or authorised agent of the Goods and that you accept these Terms on behalf of all parties with an interest in them. You further warrant that:

  • all information and documentation you provide is complete, accurate and submitted on time;
  • the Goods are properly packed, marked and labelled for the agreed mode of transport;
  • the Goods are correctly described, including any characteristics that may pose a risk; and
  • all applicable laws, licences and permits relating to the Goods have been complied with.

6. Dangerous & Prohibited Goods

You must declare in writing, before booking, any Goods that are or may become dangerous, hazardous, flammable, radioactive, perishable or otherwise require special handling. We may refuse, unload, destroy or render harmless any such Goods without compensation where they present a danger, and you remain liable for any loss, damage or expense arising from undeclared or misdeclared Goods.

7. Cargo Insurance

We do not arrange insurance for the Goods unless you instruct us to do so in writing and we confirm acceptance. Any insurance arranged is subject to the terms of the relevant policy. In the absence of such instruction, the Goods are not insured by us and you bear the risk of loss or damage beyond our limited liability set out below.

8. Liability

Our liability for loss of or damage to the Goods is limited in accordance with the applicable international convention or mandatory national law for the relevant mode of transport. Where no such convention applies, our liability is limited to the lower of the invoiced value of the Goods or the limits set out in the applicable standard trading conditions.

To the maximum extent permitted by law, we are not liable for indirect, consequential or economic loss, including loss of profit, market or use, however arising. Claims must be notified to us in writing without delay and in any event within the time limits required by the applicable convention or law, or they will be time-barred.

9. Customs & Compliance

Where we act as your customs agent, we rely on the information and documents you supply. You remain responsible for the accuracy of declarations and for any duties, taxes, penalties or fines arising from incorrect or incomplete information. You agree to indemnify us against any liability we incur as a result.

10. Payment Terms

Invoices are payable in full by the due date stated, without set-off or deduction. We may charge interest on overdue amounts at the rate permitted by law and may exercise a lien over the Goods and related documents for all sums owed to us. Disputed charges must be raised in writing before the due date.

11. Cancellation

Cancellation or amendment of a confirmed booking may incur charges, including carrier cancellation fees, documentation costs and any expenses already committed on your behalf. We will notify you of applicable charges where reasonably possible.

12. Force Majeure

We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including but not limited to acts of God, weather, war, strikes, port or border closures, carrier failure, congestion, governmental action or public health emergencies.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of [insert governing jurisdiction], and any dispute arising out of or in connection with them shall be subject to the exclusive jurisdiction of the courts of [insert jurisdiction], without prejudice to any mandatory provisions of applicable international conventions.

14. Changes to These Terms

We may update these Terms from time to time. The version published on this website at the time you request or use our Services is the version that applies. We encourage you to review this page periodically.
